The appeals process is, in many ways, more complex and specialized than trial litigation. The issues the appeals court may consider on appeal are more narrow, and the attorney preparing or defending the appeal must articulate and present those issues properly. Often, the appeals court will refuse to consider an appeal at all if the issues are not presented properly or if the court determines that it does not have the authority to overturn the trial court’s ruling.
In Florida, cases brought in state court are first brought in the County or Circuit Court, also known as the lower or trial court. Florida has 20 judicial circuits; Pinellas and Pasco Counties are in the 6th Judicial Circuit, and Hillsborough County comprises the 13th Judicial Circuit. Parties who wish to appeal a final judicial ruling from a County or Circuit Court will generally file an appeal with one of Florida’s five District Courts of Appeal. The Second District Court of Appeal serves the 6th and 13th Judicial Circuits (along with the 10th, 12th, and 20th Circuits). Further appeals from a District Court of Appeal decision are taken to the Florida Supreme Court in Tallahassee.
